If you're pursuing a Canadian job from abroad, one four-letter acronym decides almost everything: LMIA. Understanding it protects you from fraud and helps you judge whether an offer is real.

The concept in one paragraph

A Labour Market Impact Assessment is Employment and Social Development Canada's (ESDC) verdict on one question: would hiring this foreign worker hurt Canadian workers? A positive LMIA says no — the employer proved they advertised the role and couldn't find a qualified Canadian. Only then can you use that job offer to apply for an employer-specific work permit.

Who does what

This is the part applicants most often get wrong: the employer applies for the LMIA, not you. The employer pays the $1,000 government fee per position, runs at least four weeks of compliant advertising, and answers ESDC's questions — sometimes in a formal interview. Your part begins after approval: the employer gives you the LMIA number and offer letter, and you apply for the work permit with them.

Timelines

Advertising takes a minimum of four weeks, and ESDC processing typically adds several more weeks depending on the stream. End to end, a realistic LMIA-plus-work-permit timeline is three to six months — faster for some streams, slower in peak periods. Anyone promising "LMIA in one week" is either misinformed or lying.

Red flags every applicant should know

  • You're asked to pay for the LMIA. Charging the worker for LMIA costs is illegal in Canada. This is the single loudest fraud alarm.
  • A "job offer" with no employer details you can verify — real offers name a registered business you can look up.
  • Guaranteed approvals. Nobody can guarantee an ESDC or IRCC decision. Regulated consultants are prohibited from claiming otherwise.
  • LMIA "for sale." Buying and selling LMIAs is illegal and can permanently damage your immigration record.
